These terms and conditions govern the contractual relationship between Lucaservice and its clients for IT services.

2. Purpose
These terms and conditions define the conditions under which Lucaservice offers and performs IT services to professionals and individuals.
3. Description of Services
Lucaservice provides development services (web applications, custom software, automation), IT consulting and technical support. The detailed characteristics of each service are set out on the website and in customized quotes issued before any order.
4. Pricing
Prices are displayed in euros (€) inclusive of all taxes. VAT is not applicable under Article 293 B of the French Tax Code (micro-entrepreneur regime). Rates are communicated in quotes and may be revised for future orders.
5. Ordering Process
The order is formed by the client's written acceptance of the quote (signature, confirmation email or online validation). The client receives an order confirmation. Any order implies acceptance of these terms and conditions.
6. Payment Terms
Payment is due according to the schedule specified in the quote (deposit, balance on delivery, payment plan). Accepted payment methods: bank transfer, PayPal. Invoices are issued and sent in accordance with applicable regulations. Late payment penalties may apply in case of delay.
7. Performance and Delivery
Delivery timelines are indicative and communicated in the quote. Lucaservice undertakes to deploy all reasonable means to meet them. Delivery is made by handing over deliverables (source code, documentation, access) according to agreed terms. The client undertakes to provide the necessary elements and information in good time.
8. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, you have 14 days to withdraw. For digital services fully performed with your prior express consent (Article L221-28), the right of withdrawal does not apply. Please refer to our refund policy for details.
9. Warranty
Lucaservice warrants that services will be performed in accordance with professional standards and agreed specifications. In case of non-conformity, the client has a reasonable period to report reservations. Lucaservice undertakes to correct defects within an appropriate timeframe.
10. Liability
Lucaservice undertakes to provide its services with professional diligence. Its liability is limited to the amount of sums actually paid by the client for the service in question. Lucaservice shall not be held liable for indirect damages (loss of revenue, data, etc.).
11. Intellectual Property
Unless otherwise stipulated in the quote, intellectual property rights in deliverables (source code, documentation, creations) are transferred to the client upon full payment. Tools, methods and know-how proprietary to Lucaservice remain its exclusive property.
12. Personal Data
Personal data collected in the course of the commercial relationship is processed in accordance with our privacy policy and the GDPR. The client is informed of their rights of access, rectification and erasure.
13. Mediation
In accordance with the provisions of the Consumer Code relating to the amicable settlement of disputes, consumer clients may refer to the competent consumer mediator. In the event of a dispute, the parties undertake to attempt an amicable resolution before any legal proceedings.
14. Applicable Law and Jurisdiction
These terms and conditions are governed by French law. For disputes that could not be resolved amicably, French courts shall have exclusive jurisdiction. For professional clients, the competent court shall be that of Lucaservice's registered office (Paris).
